Welcome to GrowthGarner, an AI-powered grant writing platform. By accessing or using our website and services, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please refrain from using our platform.

1. Services
 

GrowthGarner provides a range of services to assist users with grant writing, including a free smart grant readiness report, feedback on written grants, and a full grant writing service. We strive to deliver high-quality, accurate, and timely services; however, we do not guarantee the success of any grant application. We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

2. User Responsibilities
 

When using GrowthGarner's platform, you agree to provide accurate, complete, and up-to-date information about your company. You are responsible for reviewing and validating the content generated using our platform to ensure its accuracy, truthfulness, and compliance with grant requirements. You must not use our services for any unlawful, fraudulent, or prohibited purpose.

3. Intellectual Property
 

All content generated by GrowthGarner's AI platform, including grant proposals and reports, is owned by the user. GrowthGarner does not claim any intellectual property rights over the content created using our platform. However, by using our services, you grant GrowthGarner a worldwide, non-exclusive, royalty-free license to use, reproduce, and display the content for the purpose of providing and improving our services. You represent and warrant that you have the necessary rights to grant this license.

4. Payment Terms
 

Payment for GrowthGarner's services is made in advance via credit card. If you opt for a success fee arrangement, payment must be made within one month of winning the grant. Refunds are not available for services already rendered, except in cases where GrowthGarner fails to deliver the agreed-upon services. Any refund requests must be made within 14 days of the initial payment.

5. Limitation of Liability
 

To the fullest extent permitted by law, GrowthGarner shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our platform or services. Our total liability for any claim arising out of or relating to these Terms or your use of our services shall not exceed the amount paid by you for the specific service giving rise to the claim. This limitation of liability shall apply regardless of the form of action, whether in contract, tort, strict liability, or otherwise.

6. User-Generated Content
 

GrowthGarner does not endorse or take responsibility for any user-generated content posted on our platform. We reserve the right to remove any content that violates these Terms, infringes upon intellectual property rights, or is deemed inappropriate. By posting content on our platform, you grant GrowthGarner a worldwide, non-exclusive, royalty-free license to use, reproduce, and display the content in connection with our services. You represent and warrant that you have the necessary rights to grant this license and that the content does not infringe upon the rights of any third party.

7. Termination
 

You may terminate your account at any time by contacting us at ed@edgrants.co.uk. Upon termination, your right to access and use our services will cease immediately. GrowthGarner may terminate your account or access to our services at any time for any reason, including breach of these Terms. Upon termination, you remain responsible for any outstanding payments owed to GrowthGarner.

8. Governing Law and Dispute Resolution
 

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any dispute arising out of or relating to these Terms or your use of our services shall be resolved through arbitration in accordance with the rules of the London Court of International Arbitration. The arbitration shall be conducted in London, and the language of the arbitration shall be English. The arbitrator's decision shall be final and binding upon both parties.

By using GrowthGarner's platform and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
